Terms of use

These terms are the agreement between you and Daultala App (shop.daultala.app), published by Asad Waheed Muhammad Waheed of Daultala Doungi Road, Daultala, Pakistan. Using the app or this website means you accept them. If you do not, please do not use them.

The content rules and the privacy policy are part of this agreement.

Who may use it

• Using the app means signing in with a Google account. Your listings are tied to it, which is what keeps them yours.
• You must be 18 or older to post a listing, run a promotion or make a payment.
• One account per person. Do not make a second one to get around something.
• You are responsible for what happens under your account. Do not let somebody else post as you.

Your listings

• Post only your own business, your own property or your own vehicle, or one you are authorised to post.
• Keep it true. The name, the street, the number, the hours and the price must be real, and the price must be the price you will honour.
• Post a contact number that is yours. Somebody else's number is never allowed.
• Take it down when it is finished. A sold bike or a closed shop left in the app wastes everybody's time.
• What may not be posted at all is in the content rules.

Promotions

• A promotion puts your picture at the top of the section you choose. The plans are Rs 800 for 1 week and Rs 1,500 for 15 days.
• One person may run up to 3 at a time.
• A promotion starts as soon as the payment goes through, and runs for the days in the plan you bought. Nothing waits for approval.
• A banner that breaks the content rules gets a WhatsApp message and 12 hours to be put right, and comes down after that. The money is not refunded, and neither are the days left on it.

Paying

• Every payment goes through Google Play's billing system, which is what Google requires of an app that sells something inside itself. Your payment is made to Google under Google's own terms, and we never see or hold your card or bank details.
• The price shown in the app is the price Google Play charges you. It is in Pakistani rupees and includes any tax Google is required to collect.
• A promotion is a one time purchase for the days in the plan. It does not renew by itself, and nothing is ever charged again unless you buy another one.
• You need a Google account with a payment method set up on Google Play. If Google refuses or reverses a payment, the promotion does not run.

Refunds

• If it was our fault, you get your money back. If a promotion never ran, or ran for fewer days than you paid for because of a fault at our end, message us and we will either run it again for the days you lost or refund it in full.
• If you stop it early, the days left are not refunded. The app says so before you confirm.
• A promotion taken down for breaking the rules is not refunded, whether it came down after the 12 hours you were given to fix it or at once because it was unlawful. See the content rules.
• Message us first, on the number on the support page. It is the quickest way, and we can usually settle it the same day.
• You may also ask Google Play for a refund through your Google account. Google decides those under its own refund policies, and a charge you did not authorise can be reported to Google for up to 120 days.
• Nothing in these terms takes away any right the consumer law of Pakistan gives you.

What this app is, and is not

It lists the businesses and the things for sale in Daultala and puts you in touch with whoever posted them. It is not a party to any deal you make, it holds no money for a sale, it does not deliver anything, and it does not check that any business is licensed, honest or any good. A listing appearing here is not a recommendation from us.

Anything you agree with somebody you found here is between the two of you. Meet in a sensible place, look at what you are buying, and use your own judgement about a price.

Things you may not do

• Post anything false, misleading or not yours to post.
• Collect numbers from the app to send bulk messages.
• Copy the listings as a whole, whether by hand or by any automated means, or use them to build a competing directory.
• Interfere with the app, try to get at accounts that are not yours, or try to get around a limit, a price or a removal.
• Use the app for anything unlawful.

Other people's services

Pressing a button in the app can hand you to somebody else: Google Play for a payment, Google Maps for directions, WhatsApp for a chat, your browser for a link an advertiser chose. Those are their services under their own terms and privacy policies, not ours, and we are not responsible for what happens once you are there.

What belongs to whom

What you post stays yours.By posting it you give us permission to show it in the app, on this website and in anything we use to describe the app, for as long as the listing is up and for a short while afterwards while copies clear. You promise that what you post is yours to post and does not break anybody else's rights.

The app is ours. The app itself, its name, its logo and its design belong to us. You may use the app as it is meant to be used; you may not copy it, sell it, take it apart or put your own name on it.

Taking things down

Nothing you post is checked before it appears. If we find that a listing or a banner breaks these terms or the content rules, we message you on WhatsApp on the number on the listing, tell you what is wrong, and give you 12 hours to put it right. If it is not put right in that time we remove it, and a paid promotion removed that way is not refunded.

Anything unlawful or dangerous is removed the moment we see it, with no warning and no refund, and the account is closed. If you think we removed something by mistake, message us and we will look again.

Ending it

You can stop at any time: delete your listings, or delete your account and everything with it. We can close an account that keeps breaking these terms. If we close yours, any promotion still running stops with it and the days left are not refunded.

What survives the end: anything you owe or we owe, the sections on liability and on what belongs to whom, and the records we are required by law to keep.

No warranty

The app is provided as it is. We do our best to keep it running and accurate, but we cannot promise it will always be available, that it will be free of faults, or that every listing in it is correct.

Liability

As far as the law allows, we are not liable for loss arising from a deal made through the app, from a listing being wrong, from somebody you met through it, or from the app being unavailable. Where we are liable for something, and the law allows a limit, that limit is what you have paid us in the twelve months before it happened.

Nothing here limits liability for death, personal injury, fraud, or anything else the law does not allow to be limited.

Putting it right

If something you posted lands us in a claim from somebody else, you agree to cover what that costs us, so far as it was your doing.

Changes

These terms may change, and the app itself will change: features come and go. The date at the top changes with the terms, and anything important will be said in the app too. If a change does not suit you, stop using the app and delete your account.

Reaching each other

We reach you through the app, through a notification, or on the number on your account. You reach us on WhatsApp, on the number below. A message sent to us on a Friday or a holiday is answered the next working day.

If part of this does not hold

If a court finds one part of these terms unenforceable, the rest still stands. Not enforcing something once does not mean we have given it up. You may not transfer this agreement to somebody else; we may transfer it if the app changes hands, and this agreement is the whole of what is between us about the app.

Law

These terms are governed by the laws of Pakistan, and the courts of Rawalpindi have jurisdiction over any dispute. Before going to court, message us: nearly everything is settled that way in a day.
